The Constitution of the Republic of Rwanda was adopted by referendum on 26 May 2003 and entered into force on 4 June of the same year. The current Constitution incorporates three amendments from its adoption (2003, 2005 and 2008), the most recent being from August 13, 2008.
The Constitution provides for a clear separation of powers, with a legislative branch composed of an independent bicameral parliament; an executive branch comprising the Prime Minister, Ministers, Ministers of State and other members who may be determined, if necessary, by the President of the Republic; and a judicial branch composed of: the Supreme Court, high courts of the Republic, provincial courts, districts courts, and mediation committees.
This Constitution does not contain specific provisions concerning the protection of Intellectual Property rights, however, Article 29 of Chapter I: “Fundamental Human Rights”, in Title II: “Fundamental Human Rights and Rights and Duties of the Citizen” guarantees the respect of private property.
