Year of Version 2013 Dates Entry into force: July 10, 2013 Issued: July 8, 2013 Type of Text Implementing Rules/Regulations Subject Matter Copyright and Related Rights (Neighboring Rights), Enforcement of IP and Related Laws Notes Article 1 of this Decree amends Article R.331-37 of the Intellectual Property Code by adding the following words after “communicate” : “by the automated processing of personal data mentioned under Article L. 331-29 by the recording medium to ensure their security and integrity.” This amendment provides that the operators of electronic communications can use the automated processing of personal data or the recording medium to communicate to the Commission for the Protection of Rights of “HADOPI”, the personal data of subscribers, whose access to public on line communication services has been used to reproduce, represent, make available, or communicate to the public protected works or objects without authorization from the owners of the rights set forth in Books I and II (relating to copyright and related rights) when it is required. Article 2 of the Decree repeals paragraph III of Article R. 335-5, which provided for a complementary penalty of suspending access to an on-line public communication service for a maximum length of one month in case of the offence of “specific negligence” or “gross negligence” for internet subscribers who have not installed an online security solution for their internet connection or lacked diligence in implementing this solution. Accordingly, only a Class 5 offence (a misdemeanor penalty) shall be imposed for the offence of the gross negligence against the subscribers.
