Year of Version 2004 Dates Entry into force: July 1, 2004 Adopted: June 4, 2004 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Industrial Designs, Geographical Indications, Plant Variety Protection, Enforcement of IP and Related Laws Notes These Regulations, issued pursuant to section 2(2) of the European Communities Act 1972, amend the Goods Infringing Intellectual Property Rights (Customs) Regulations 1999 and the Goods Infringing Intellectual Property Rights (Consequential Provisions) Regulations 1999. These Regulations implement the Council Regulation (EC) No. 3295/1994, as amended by the Council Regulation (EC) No 241/1999, which provides for the measures in relation to the entry into the Community of goods infringing intellectual property rights.
These Regulations repeat regulations 2 to 8 of the Goods Infringing Intellectual Property Rights (Consequential Provisions) Regulations 1999 to reflect the provisions of the Council Regulation 1383/2003.
These regulations revoke and replace The Trade Marks (EC Measures Relating to Counterfeit Goods) Regulations 1995. These Regulations also revoke the Goods Infringing Intellectual Property Rights (Customs) Regulations 2003.
Regulations 12 and 13 of these Regulations amend section 111(3B) of the Copyright, Designs and Patents Act 1988 and section 89(3) of the Trade Marks Act 1994 in order to implement the provisions of the Council Regulation 1383/2003.
Regulation 14 of these Regulations revokes the Regulations listed in the Schedule to it.
