Year of Version 2012 Dates Entry into force: June 21, 1985 Adopted: December 21, 1984 Type of Text IP-related Laws Subject Matter Competition, Undisclosed Information (Trade Secrets) Notes The Penal Code (Law No. 11.179) was adopted on December 21, 1984, and published in the Official Gazette on January 16, 1985 (B.O. 16/01/1985). According to Article 314 of the Penal Code, it entered into force 6 months after the date of its promulgation. It has been last amended by Law No. 26.842 of December 19, 2012 on Prevention and Punishment of Human Trafficking and Assistance to Victims, which was published in the Official Gazette on December 27, 2012 (B.O. 27/12/2012).

This consolidated version of the Penal Code, approved by Decree No. 3992/84 incorporates all the amendments up to December 19, 2012.
Article 156 stipulates that those who due to their status, trade, employment, profession or craft without justification disclose secrets to which they had access, when such disclosure can cause damages, shall be punished by a fine of one thousand and five hundred pesos to ninety thousand pesos, and shall be disqualified from six months to three years.
Article 159 imposes sanctions on unfair competition, which provides that the persons who by means of fraudulent machinations, false accusations or any means of unfair advertising, intend to divert, to themselves, clients of a commercial or industrial establishment shall be punished by a fine of two thousand five hundred dollars to thirty thousand dollars.
Article 222 indicates, among others, that those who disclose industrial and technological secrets related to security defense or external relations shall be punished to imprisonment from one to six years.
