Year of Version 1998 Dates Entry into force: August 12, 1998 Adopted: July 22, 1998 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Trademarks, Undisclosed Information (Trade Secrets), IP Regulatory Body, Other Notes The Resolution No. 350/99 has been issued by the Ministry of Agriculture, Livestock, Fisheries and Food (SAGPyA, Spanish acronym), which has been now renamed as the Ministry of Agriculture, Livestock and Fisheries.

This Resolution establishes the registration requirements for the phytosanitary products in the Republic of Argentina. It contains specific provisions on the description of trade names and certificates of origin of a formulated product for the registration process [Chapter 5 (I(3& 4)]; the notification of the patent certificate during the registration process of differentiated-treatment products [Chapter 8 (I(c)]; the maintenance of records for trademarks of technical grade active substances [Chapter 9 (7.2.a) & (8a)]; and the notification of the patent certificate for active substances and plant protection products to the National Health and Agri-Food Quality Service (SENASA) by the holders of a registration certificate, as specified in Articles 1 to 3 of Annex II on the procedures in relation to Article 8 of the Law No. 24.766 on Confidential Information.

Chapter 2 of the Resolution provides, among others, that the National Health and Agri-Food Quality Service (SENANA) is bound by the duty of confidentiality not to disclose or use confidential information relating to the technical and scientific information provided for the registration of phytosanitary products, in accordance with Articles 1, 3 and 7 of the Law No. 24.766 on Confidential Information.

Article 5 of the Resolution stipulates that it shall take effect on the day following its publication in the Official Gazette. The Resolution was published in the Official Gazette on August 11, 1998 (B.O. 11/08/98), and came into force the following day.
