Inconsistencies in regulations

OFFICIAL STATUS OF CONSOLIDATIONS

Subsections 31(1) and (3) of the Legislation Revision and Consolidation Act, in force on June 1, 2009, provide as follows:

31. (1) Every copy of a consolidated statute or consolidated regulation published by the Minister under this Act in either print or electronic form is ev- idence of that statute or regulation and of its contents and every copy purporting to be published by the Minister is deemed to be so published, unless the contrary is shown.

(3) In the event of an inconsistency between a consolidated regulation published by the Minister under this Act and the original regulation or a subse- quent amendment as registered by the Clerk of the Privy Council under the Statutory Instruments Act, the original regulation or amendment prevails to the extent of the inconsistency.

NOTE

This consolidation is current to April 27, 2015. The last amendments came into force on Septem- ber 1, 2011. Any amendments that were not in force as of April 27, 2015 are set out at the end of this doc- ument under the heading “Amendments Not in Force”.

Broadcasting Information Regulations, 1993

Whereas, pursuant to subsection 10(3) of the Broad- casting Act*, a copy of the proposed Regulations respect- ing broadcasting information requirements, substantially in the form annexed hereto, was published in the Canada Gazette Part I on July 3, 1993 and a reasonable opportu- nity was thereby given to licensees and other interested persons to make representations to the Canadian Radio- television and Telecommunications Commission with respect thereto;

Therefore, the Canadian Radio-television and Telecommunications Commission, pursuant to subsec- tion 10(1) of the Broadcasting Act*, hereby makes the annexed Regulations respecting broadcasting informa- tion requirements.

Attendu que, conformément au paragraphe 10(3) de la Loi sur la radiodiffusion*, le projet de Règlement concer- nant les renseignements relatifs à la radiodiffusion, conforme en substance à l’annexe ci-après, a été publié dans la Gazette du Canada Partie I le 3 juillet 1993 et que les titulaires de licences et autres intéressés ont ainsi eu la possibilité de présenter leurs observations à cet égard au Conseil de la radiodiffusion et des télécommu- nications canadiennes,

À ces causes, en vertu du paragraphe 10(1) de la Loi sur la radiodiffusion*, le Conseil de la radiodiffusion et des télécommunications canadiennes prend le Règlement concernant les renseignements relatifs à la radiodiffu- sion, ci-après.

REGULATIONS RESPECTING BROADCASTING INFORMATION REQUIREMENTS

SHORT TITLE

1. These Regulations may be cited as the Broadcast- ing Information Regulations, 1993.

SUBMISSION OF INFORMATION

2. (1) Subject to section 3, on or before November 30 of each year, a licensee that charges a fee to subscribers or to another licensee that charges a fee to subscribers shall submit to the Commission a statement of accounts, on the annual return of broadcasting licensee form, for the year ending on the previous August 31.

(2) At the request of the Commission, a licensee shall respond to

(a) any complaint or request for resolution of a dis- pute filed by any person or any request for informa- tion regarding the programming originated or dis- tributed by the licensee or regarding the licensee’s technical operations, subscribership, financial affairs or ownership; and

(b) any request for information regarding the li- censee’s adherence to the conditions of its licence, the Act, these Regulations, industry standards, practices or codes or any other self-regulatory mechanism of the industry.

(3) In this section, “subscriber” means

(a) a household of one or more persons, whether oc- cupying a single-unit dwelling or a unit in a multiple- unit dwelling, to which service is provided directly or indirectly by the holder of a licence, as defined in sec- tion 2 of the Broadcasting Act; or

(b) the owner or operator of any hotel, hospital, nurs- ing home or other commercial or institutional premis- es to which service is provided by the holder of a li- cence, as defined in section 2 of the Broadcasting Act.

FOURNITURE DE RENSEIGNEMENTS

2. (1) Sous réserve de l’article 3, au plus tard le 30 novembre de chaque année, le titulaire d’une licence qui impose un tarif aux abonnés ou à un autre titulaire d’une licence qui impose un tarif aux abonnés, fournit au Conseil, sur le formulaire du rapport annuel du titulaire d’une licence, un état de compte pour l’année se termi- nant le 31 août précédent.

(2) À la demande du Conseil, le titulaire répond :

a) à toute plainte ou demande de règlement de diffé- rend déposée par toute personne ou à toute demande de renseignements concernant la programmation dont il est la source ou qu’il distribue, ses opérations tech- niques, ses statistiques d’abonnés, ses affaires finan- cières ou concernant la propriété dont il est l’objet;

b) à toute demande de renseignements concernant le respect des conditions de sa licence, de la Loi, du pré- sent règlement, ainsi que des normes, pratiques, codes et autres mécanismes d’autoréglementation de l’indus- trie.

(3) Au présent article, «abonné» s’entend, selon le cas :

a) d’un ménage qui est composé d’une ou de plu- sieurs personnes occupant un logement unifamilial ou un des logements d’un immeuble à logements mul- tiples et auquel le titulaire d’une licence au sens de l’article 2 de la Loi sur la radiodiffusion fournit direc- tement ou indirectement des services;

b) du propriétaire ou de l’exploitant d’un hôtel, d’un hôpital, d’une maison de repos ou de tout autre local commercial ou établissement auquel le titulaire fournit des services.

3. Any licensee that is required by any other regula- tion made under the Broadcasting Act to submit to the Commission any information requested on the form re- ferred to in subsection 2(1) or on any matter referred to in subsection 2(2) is not required to submit the informa- tion to the Commission pursuant to that subsection.

3. Le titulaire d’une licence qui, aux termes de tout autre règlement pris en vertu de la Loi sur la radiodiffu- sion, est tenu de fournir au Conseil les renseignements sur le formulaire mentionné au paragraphe 2(1) ou de fournir les renseignements visés au paragraphe 2(2) n’est pas tenu de fournir ces renseignements au Conseil conformément à ces paragraphes.
