The notification by Australia to the WTO under article 63.2 of TRIPS states:
'This Regulation amends:
- the Patents Regulations 1991 and the Trade Marks Regulations 1995 to enable the implementation of a single, trans-Tasman patent attorney regime (Schedules 1 and 2);
- the Designs Regulations 2004 and the Plant Breeder's Rights Regulations 1994 to allow an address for the service of documents to be in New Zealand (Schedule 3);
- the Patents Regulations and Trade Marks Regulations to ensure consistency with international obligations (Schedule 4);
- the Trade Marks Regulations to allow the Registrar of Trade Marks to identify, and refuse to protect, unclearly specified goods or services set out in international trade mark applications (Schedule 5);
- the Trade Marks Regulations and the Plant Breeder's Rights Regulations to reflect the changes to the administration of Norfolk Island made in July 2016 (Schedule 6).'
The Intellectual Property Legislation Amendment (Single Economic Market and Other Measures) Regulation 2016 was repealed on July 2, 2017, in accordance with Division 1 of Part 3 of Chapter 3 of the Legislation Act 2003.
