Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Notification by the European Patent Organisation (EPO) of an Extension of the List of Kinds of Microorganisms Accepted by the Centraalbureau voor Schimmelcultures (CBS)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on May 22, 1985, of the notification of the European Patent Organisation (EPO) stating that the assurances furnished by the European Patent Organisation (EPO) in respect of the Centraalbureau voor Schimmelcultures (CBS), an institution having the status of an international depository authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977 (see Budapest Notification No. 21 of August 27, 1981), are extended to include the kinds of microorganisms specified in the notification of the European Patent Organisation (EPO). The text of that notification is attached.

The said assurances shall become applicable to the kinds of microorganisms specified in the notification of the European Patent Organisation (EPO) as from the date (August 31, 1985) of the publication in the July-August 1985 issue of Industrial Property/La Propriété industrielle of that notification.

Text of the Notification of the European Patent Organisation (EPO), dated May 15, 1985, stating an extension of the list of kinds of microorganisms accepted for deposit by the Centraalbureau voor Schimmelcultures (CBS)

NOTIFICATION

I refer to the communication under Article 7(1) of the Budapest Treaty made on July 27, 1981, by my predecessor, Mr. van Benthem, to acquire the status of international depository authority for the Centraalbureau voor Schimmelcultures (CBS), located in the Netherlands.

Pursuant to Rule 3.3 of the Regulations under the Budapest Treaty, I have the honor to notify to you that the assurances furnished by the European Patent Organisation that, the Centraalbureau voor Schimmelcultures (CBS) complies and will continue to comply with the requirements specified in Article 6(2) of the Treaty, also extend to the following type of microorganism:

Bacteria other than actinomycetes.

The following are applicable to the additional type of microorganism accepted by CBS:

(a) the part of the communication of July 27, 1981, concerning the fact that irrespective of where the microorganisms are stored, all deposits must be effected at the headquarters in Baarn, to which all correspondence must likewise be addressed:

(b) the amended schedule of fees of CBS applicable as of May 30, 1984;

(c) the requirements of CBS under Rule 6.3 of the Regulations under the Budapest Treaty.
