Database of Biodiversity-related Access and Benefit-sharing Agreements
Background Information
As part of the work of the WIPO Intergovernmental Committee on Genetic Resources, Traditional Knowledge and Folklore (IGC), WIPO is currently in the process of compiling an on-line, searchable database of biodiversity-related Access and Benefit-Sharing Agreements and related information, with a particular emphasis on the intellectual property aspects of such agreements.
This WIPO work program responds to a widely-felt need for more information about current practices concerning intellectual property aspects of agreements on access to genetic resources and the sharing of consequential benefits. A comprehensive explanation of this process can be found in documents WIPO/GRTKF/IC/3/4 and WIP/GRTKF/IC/5/9. Further information on updating of the database in response to a decision taken by the IGC in 2010 can be found in document WIPO/GRTKF/IC/17/INF/11.
Replies contained in this database were compiled from a questionnaire [DOC] that was disseminated by WIPO to IGC participants, together with a wide ranging group of stakeholders with practical experience of contractual practices and agreements relating to intellectual property, access to genetic resources and benefit-sharing: for instance, government agencies, indigenous peoples and local communities, their legal representatives, commercial and industrial organizations, and source country and receiving country research institutions, such as universities and ex situ collections.
The database seeks to provide information on the general approach taken in concluding relevant agreements and to stimulate the flow of information in this important area, rather than to serve as a database of legal texts and precedents. Potential contributors were informed that it was not necessary to provide the actual text, or the detailed provisions of any contract, especially if the details were sensitive or confidential, or the text of the provisions was particularly complex. A general description of each provision was welcomed.
