東日本大震災の発生に伴うPCTにおける救済措置についてWIPO国際事務局からのお知らせ
平成23年3月11日発生の東日本大震災の影響により、PCTに関する所定の手続ができなくなった方にお知らせいたします。東日本大震災の発生に伴うPCT における救済措置について、「Relief Measures Following the Recent Earthquake in Japan」名のタイトルの記事がNewsletter 2011年4月号に掲載されています。下記に該当箇所の英語原文及び日本語仮訳（翻訳の過程で不正確な記載が生じている場合には、全て英語版に記載されたものが優先します）を掲載いたします。

Relief Measures Following the Recent Earthquake in Japan
In connection with the effects of the recent earthquake in Japan, the attention of applicants is drawn to the fact that, in cases where the applicant has missed the 12-month priority period for filing the international application, restoration of the right of priority may be available (PCT Rule 26bis.3). Applicants who normally file their international applications with the Japan Patent Office as receiving Office (RO/JP) should note, however, that in view of the fact that that Office does not accept requests for restoration of the right of priority, applicants would have to either file the international application directly with the International Bureau as receiving Office (RO/IB) in order to be able to submit a request for restoration of the right of priority to RO/IB, or, where the international application has already been filed with RO/JP, submit a request for restoration of the right of priority and request RO/JP to transmit the international application to RO/IB under PCT Rule 19.4(a)(iii) for further processing.
As far as other time limits under the PCT are concerned, PCT Rule 82 (Irregularities in the mail service (due to delay or loss in mail, or interruption in the mail service)) may apply in respect of documents relating to international applications the mailing of which may have been delayed because of the effects of the natural disaster.

東日本大震災に伴う救済措置
東日本大震災の影響に関連して、出願人が国際出願の出願について12ヶ月の優先期間を徒過した場合、優先権の回復が利用できる可能性がある点、出願人に注意喚起いたします（PCT規則26の2.3）。しかしながら、通常国際出願を受理官庁としての日本国特許庁（RO/JP）に行っている出願人は、日本国特許庁が優先権の回復の請求を受け付けていないことから、さらなる手続を進めるには、優先権の回復の請求を受理官庁としての国際事務局（RO/IB）に提出できるようRO/IBに直接国際出願を提出するか、あるいは、国際出願がすでにRO/JPに提出されている場合、優先権の回復の請求の提出及びPCT規則19.4(a)(iii)に基づくRO/JPに対する国際出願のRO/IBへの転送の請求を行うか、のいずれかを行わなければなりません。
PCT規則に定められている他の期限に関して、国際出願に関連する文書に関して、PCT規則82（郵便業務における異常（郵便の遅延又は郵便物の紛失、又は郵便業務の中断））が天災の影響のため遅れた郵便に対して適用される可能性があります。
