PCT Information Update

International filing fee, search fee, supplementary search fee and handling fee (various Offices)

On 1 January 2015, there will be changes in the equivalent amounts, in certain currencies, of the international filing fee, the fee per sheet over 30, the PCT-EASY and electronic filing reductions (where applicable) listed in item 4 of the Schedule of Fees, the search fee, the supplementary search fee and the handling fee, as indicated in the PCT Fee Tables.

These changes update the following annexes of the PCT Applicant’s Guide (http://www.wipo.int/pct/guide/en/):

Annex C (receiving Offices): AM, AP, AT, AU, AZ, BA, BE, BH, BW, BY, BZ, CA, CL, CR, CU, CY, CZ, DE, DK, DO, EA, EC, EE, EG, EP, ES, FI, FR, GB, GE, GH, GR, GT, HN, HU, IB, IE, IL, IN, IS, IT, JP, KE, KG, KZ, LR, LT, LU, LV, MC, MD, MT, MW, MX, NI, NL, NO, NZ, PA, PE, PG, PH, PT, RO, RU, SA, SC, SE, SG, SI, SK, SM, SV, SY, TJ, TM, TT, UA, US, UZ, ZA, ZM, ZW;

CL Chile (electronic filing; fees)

For information on the acceptance, with effect from 1 January 2015, by the National Institute of Industrial Property (Chile) as receiving Office of international applications filed using ePCT-Filing, as well as information on the electronic filing fee reductions listed in item 4 of the Schedule of Fees that will be applicable, see “Electronic Filing and Processing of International Applications”, above.

CY Cyprus (location and mailing address; fees)

The location and mailing address of the Department of Registrar of Companies and Official Receiver of Cyprus has changed, as follows:

The amount of the transmittal fee, payable to the Office as receiving Office, has changed to EUR 163.

IB International Bureau (fees)

As from 1 January 2015, there will be a change in the equivalent amounts in EUR and USD of the transmittal fee and a change in the equivalent amount in USD of the fee for the priority document, payable to the International Bureau (IB) as receiving Office, as follows:

IL Israel (national security provisions)

The Israel Patent Office has provided additional details to the IB concerning restrictions in its national legislation which are applicable when filing international applications with other Offices.

IN India (electronic filing; fees)

For information on the acceptance, with effect from 15 November 2014, by the Indian Patent Office as receiving Office of international applications filed using ePCT-Filing, as well as information on the electronic filing fee reductions listed in item 4 of the Schedule of Fees that are now applicable, see “Electronic Filing and Processing of International Applications”, above.

IR Islamic Republic of Iran (competent International Searching and Preliminary Examining Authorities)

The Industrial Property Office (Islamic Republic of Iran) has specified, with effect from 1 March 2015, the State Intellectual Property Office of the People’s Republic of China, in addition to the European Patent Office, the Indian Patent Office and the Federal Service for Intellectual Property (Rospatent) (Russian Federation), as competent International Searching and Preliminary Examining Authority for international applications filed by nationals and residents of the Islamic Republic of Iran with the Industrial Property Office (or the International Bureau) as receiving Office.

IS Iceland (fees)

There have been changes in the following national fees payable to the Icelandic Patent Office as designated (or elected) Office with effect from 1 December 2014:

KR Republic of Korea (e-mail notifications)

The Korean Intellectual Property Office, in its capacity as International Searching Authority (ISA) or International Preliminary Examining Authority (IPEA), has notified the IB that it will send notifications by e-mail in respect of international applications, if authorized, to applicants who did not file their international application with that Office as receiving Office, with effect from 1 December 2014. For a transition period of six months these applicants will receive notifications via e-mail and post.

LT Lithuania (fees)

As from 1 January 2015, the official currency of Lithuania will change from Lithuanian lita (LTL) to euro (EUR). With effect from that date, there will be a change in the currency and amounts of the fees payable to the State Patent Bureau of the Republic of Lithuania as receiving Office, as follows:

MX Mexico (competent International Searching and Preliminary Examining Authorities)

The Mexican Institute of Industrial Property has specified, with effect from 10 November 2014, the National Institute of Industrial Property (Chile) (INAPI), in addition to the European Patent Office, the Spanish Patent and Trademark Office, the Swedish Patent and Registration Office and the United States Patent and Trademark Office, as competent International Searching and Preliminary Examining Authority for international applications filed by nationals and residents of Mexico with the Mexican Institute of Industrial Property (or the IB) as receiving Office.

MY Malaysia (number of copies required)

The Intellectual Property Corporation of Malaysia has changed its requirement concerning the number of copies of the international application to be filed with it as receiving Office: it now requires one copy, instead of three.

NL Netherlands (number of copies required)

The Netherlands Patent Office has changed its requirement concerning the number of copies of the international application to be filed with it as receiving Office: it now requires one copy, instead of three.

SE Sweden (languages accepted for supplementary international search)

The Swedish Patent and Registration Office has added the Finnish language to the list of languages accepted for supplementary international search. It will now accept requests for supplementary international search based on international applications filed in – or with translations furnished into – Danish, English, Finnish, Norwegian and Swedish.
