PCT Information Update

Please note that some of the fee changes announced below were already included in the PCT Fee Tables that were published separately on the PCT website in August 2014, in advance of the announcement in this section of the PCT Newsletter.

AU Australia (filing of PCT-EASY requests together with PCT-EASY physical media, fees)

The Australian Patent Office, in its capacity as receiving Office, has notified the International Bureau that it will no longer accept international applications with requests in PCT-EASY format with effect from 1 November 2014 (it is recalled that the Office does accept applications filed using ePCT-Filing and PCT-SAFE). Consequently, the corresponding reduction under item 4 of the PCT Schedule of Fees will no longer apply from that date.

BE Belgium (location and mailing address; fees)

The location and mailing address of the Intellectual Property Office (Belgium) has changed, as follows:

The Office has notified the International Bureau (IB) that the “fiscal duties” component of the fee for priority document (EUR 5), payable to the Office as receiving Office, no longer applies. Also, with effect from 22 September 2014, the amount of the transmittal fee will change to EUR 120.

BN Brunei Darussalam (summary of requirements for entry into the national phase)

Information on the requirements of Brunei Intellectual Property Office (BruIPO) as designated (or elected) Office has been published in the PCT Applicant’s Guide, National Chapter, Summary at:

CL Chile (competent International Searching and Preliminary Examining Authorities)

The National Institute of Industrial Property (Chile) (INAPI) has specified itself, in addition to the European Patent Office, the Korean Intellectual Property Office, the Spanish Patent and Trademark Office and the United States Patent and Trademark Office, as competent International Searching and Preliminary Examining Authority for international applications filed by nationals and residents of Chile with INAPI (or the IB) as receiving Office. This will take effect on 22 October 2014, the date on which INAPI will start functioning as an International Searching and Preliminary Examining Authority.

Annexes D and E for Chile will be published in the PCT Applicant’s Guide shortly.

CU Cuba (competent International Searching and Preliminary Examining Authorities)

The Cuban Industrial Property Office has specified the National Institute of Industrial Property (Brazil) (with effect from 5 August 2014) and the National Institute of Industrial Property (Chile) (INAPI) (with effect from 22 October 2014 (the date on which INAPI will start functioning as an International Searching and Preliminary Examining Authority)), in addition to the Austrian Patent Office, the European Patent Office, the Federal Service for Intellectual Property (Rospatent) (Russian Federation) and the Spanish Patent and Trademark Office, as competent International Searching and Preliminary Examining Authorities for international applications filed by nationals and residents of Cuba with the Cuban Industrial Property Office (or the IB) as receiving Office.

EC Ecuador (competent International Searching and Preliminary Examining Authorities)

The Ecuadorian Institute of Intellectual Property (IEPI) has specified the National Institute of Industrial Property (Chile) (INAPI), in addition to the European Patent Office and the Spanish Patent and Trademark Office, as competent International Searching and Preliminary Examining Authority for international applications filed by nationals and residents of Ecuador with IEPI (or the IB) as receiving Office. This will take effect on 22 October 2014, the date on which INAPI will start functioning as an International Searching and Preliminary Examining Authority.

Annexes D and E for Chile will be published in the PCT Applicant’s Guide shortly.

EP European Patent Office (fees)

There has been a change concerning the reductions in the national fee payable to the European Patent Office as designated (or elected) Office. In certain cases the examination fee is now reduced by 30% for language reasons.

IN India (fees)

There have been changes in the amounts of the following fees, payable to the Indian Patent Office as receiving Office, including new reduced amounts for these fees under certain conditions with effect from 28 February 2014, as follows:

PA Panama (competent International Searching and Preliminary Examining Authorities)

The Directorate General of the Industrial Property Registry (DIGERPI) (Panama) has specified the National Institute of Industrial Property (Chile) (INAPI), in addition to the National Institute of Industrial Property (Brazil), the European Patent Office, the Spanish Patent and Trademark Office and the United States Patent and Trademark Office, as competent International Searching and Preliminary Examining Authority for international applications filed by nationals and residents of Panama with DIGERPI (or the IB) as receiving Office. This will take effect on 22 October 2014, the date on which INAPI will start functioning as an International Searching and Preliminary Examining Authority.

SE Sweden (fees)

As from 1 October 2014, there will be a change in the equivalent amounts of the international filing fee and the fee per sheet over 30, payable in SEK to the Swedish Patent and Registration Office as receiving Office, as well as a change in the equivalent amount(s) in SEK of the fee reductions listed in item 4 of the Schedule of Fees, as indicated in Fee Table I(a).

Search fee (Australian Patent Office, European Patent Office, Federal Service for Intellectual Property (Rospatent) (Russian Federation), National Institute of Industrial Property (Brazil), National Institute of Industrial Property (Chile), Nordic Patent Institute, Korean Intellectual Property Office, Swedish Patent and Registration Office)

On 1 August 2014, there was a change in the equivalent amount payable in ISK for an international search carried out by the Nordic Patent Institute and the Swedish Patent and Registration Office.

As from 1 October 2014, there will be changes in the equivalent amounts payable in the currencies specified below for international searches carried out by the following Offices:

A new Annex D for Chile, which will contain the amount of the fee that will be payable in USD, as well as the equivalent amounts in EUR and CHF, for an international search carried out by the National Institute of Industrial Property (Chile) with effect from 22 October 2014, the date on which INAPI will start functioning as an International Searching Authority, will be published in the PCT Applicant’s Guide shortly.

Preliminary examination fee (National Institute of Industrial Property (Chile)

A new Annex E for Chile, which will contain the amount of the fee that will be payable in USD for an international preliminary examination carried out by the National Institute of Industrial Property (Chile) with effect from 22 October 2014, the date on which INAPI will start functioning as an International Preliminary Examining Authority, will be published in the PCT Applicant’s Guide shortly.

Handling Fee (Swedish Patent and Registration Office)

As from 1 October 2014, there will be a change in the equivalent amount of the handling fee, payable in SEK to the Swedish Patent and Registration Office as International Preliminary Examining Authority. The new amount will be SEK 1,520.
