Telecoms Firms Lead WIPO International Patent Filings

Three telecoms giants from China and the United States led international patent filing activity via WIPO in 2014, a fifth consecutive record-breaking year amid overall growth in the Organization’s global intellectual property services. Together, China and the U.S. accounted for 87% of the total growth in filings under WIPO’s Patent Cooperation Treaty (PCT), which saw some 215,000 applications in 2014, a 4.5% increase over the previous year. In a significant development, the U.S. became the biggest filer of international trademark applications under WIPO’s Madrid System.

World IP Day 2015 – Get up, stand up. For music.

When Bob Marley and the Wailers laid down the opening track on Burnin’ in a Kingston recording studio some four decades ago, they likely had little idea how far their simple, straightforward tune would resonate, becoming an enduring international anthem for human rights. Such is the power of music. Since the earliest rhythms emerged and evolved into this most universal of creative expressions, music has moved us. From Beijing opera to the Vienna Philharmonic, from Bamako blues to Chicago house, from raga to raï to township to dubstep, music transcends borders and connects with some primal beat within all of us. Even when we are not listening, music is often playing over in our minds – a soundtrack to our thoughts.

United States Deposits Instrument of Ratification to Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs

The U.S. Department of Commerce’s United States Patent and Trademark Office (USPTO) today announced that the United States has deposited its instrument of ratification to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs (Hague Agreement) with the World Intellectual Property Organization (WIPO) in Geneva, Switzerland. This marks the last step in the membership process for the United States to become a Member of the Hague Union. The treaty will go into effect for the United States on May 13, 2015.

Intellectual Asset Management for Universities

This guide aims to help senior university managers set strategies to make the most of the benefit from the intellectual assets created by their staff and students. ‘Intellectual assets’ is a broad term that varies in definition. In the context of this guide, ‘Intellectual assets’ extends beyond Intellectual Property (IP) rights to the know-how and trade secrets of the staff and students. This guide will help individual institutions adopt their own strategic approach allowing them to use their IP to secure greatest benefit for the economy and society.

According to the World Intellectual Property Organization (WIPO), the practice of using IP as collateral in lending is “a recent phenomenon even in developed countries”. WIPO defines IP as “creations of the mind”, that is, inventions, literacy and artistic works, designs, symbols, names and images that are used in commerce.

Guide to Trademark Registration in Brazil

A trademark is a distinctive sign, visually perceptible, capable of identifying and distinguishing similar products or services from different origin. In Brazil, trademark registration is governed by the Ley de Propiedad Industrial (Intellectual Property Law). INPI is the organization responsible for dealing with trademark applications. It should be mentioned that trademarks protected by INPI registration are only valid in Brazil.

Copyright and the Music Marketplace

This study provide principles it feels should guide copyright reform: government uses of music should aspire to treat like uses of music alike; government supervision should enable voluntary transactions while still supporting collective solutions; rate-setting and enforcement of antitrust laws should be separately managed and addressed; and a single-market oriented rate-setting standard should apply to all music uses under statutory licenses.

Permanent Injunctive Relief for Trade Secret Misappropriation without an Express Limit upon Its Duration: The Uniform Trade Secret Act Reconsidered

This article discusses whether a permanent injunction issued after a trial on the merits under the Uniform Trade Secrets Act (“Uniform Act”) should have an express expiration date. The common law cases are in conflict with respect to former trade secrets that have entered the public domain. Although the Uniform Act was promulgated by the National Conference of Commissioners on Uniform Laws in 1979 and has statutory language and commentary addressing the issue, case-law has continued to conflict under the Act.

The Protection of Biodiversity and Traditional Knowledge: A Comparative Law Methodology Proposal

Biodiversity and traditional knowledge are lacking of a solid legal status. International Law and domestic legislations have mistakenly attempted to regulate this issue, since they have usually ignored the reality and social dimensions herein. This is therefore a proposal about how to grapple with this issue using a comparative and pluralist approach. However, this process entails the reflection and the justifications of the choices within a comparative study. Those dynamics imply to leave the strict positivism so as to utilize the interdisciplinary approach of law.

Vermont vs. the Patent Troll: Is State Action a Bridge Too Far?

In May 2013, Vermont became the first state to pass legislation targeting “bad-faith Patent Assertion Entities (PAEs)”, also known as “patent trolls”. Vermont’s anti-patent trolling law, which is certain to face a federal preemption challenge on the basis that federal patent law trumps and negates any state patent law, uses careful language and nuance in an attempt to thread the needle of federal preemption. This Note will discuss the likely outcome of any legal challenge to Vermont’s authority to enact the anti-patent trolling statute.

WIPO Summer Schools

WIPO, in cooperation with the partners, will hold summer schools in 2015 in Santiago, New Delhi, Shanghai, Singapore, Mexico City, Geneva, St. Petersburg, Daejeon, Alexandria, and Durban.  Registration is now open for three venues, Santiago, New Delhi and Shanghai, which will take place from January 19 to 30, March 2 to 13, and May 4 to 15, 2015, respectively. 

The purpose of the WIPO summer schools is to provide deeper knowledge on each domain of IP to senior students and young professionals and to orient them towards the interface between IP and other disciplines.
