Objectives and Main Features of the Internet Discussion Forum on Replacement

At its third session, held in Geneva from January 29 to February 2, 2007, the Ad hoc Working Group on the Legal Development of the Madrid System for the International Registration of Marks (hereinafter referred to as “the Working Group”) agreed with the establishment of an open Internet Discussion Forum to foster the exchange of views, with an object of simplification and harmonization, on the question of replacement under Article 4 bis (1) of the Madrid Agreement Concerning the International Registration of Marks and of the Madrid Protocol Relating to the Madrid Agreement. In order to assist the exchange of views in the Forum, the International Bureau of the World Intellectual Property Organization (WIPO) has prepared a background paper on the objectives of replacement (see document MM/LD/WG/3/5 “Report”, paragraph 69).

The participation in the Forum is open for all the interested parties. A reference is made to Terms of Use of WIPO websites, which contain a General Disclaimer as regards the content of the websites as well as the guidelines for WIPO Privacy Policy.

WIPO retains the right to refuse or delete any message, material or link, which is defamatory, obscene, abusive or threatening from the Forum. WIPO also retains the right to archive, in its records, all submissions to the Forum.

Independently of the setting up of the Internet Discussion Forum, the International Bureau has, as decided by the third session of the Working Group, prepared a questionnaire on replacement [DOC] [PDF] to be replied to by national and regional offices (see document MM/LD/WG/3/5 “Report” , paragraph 69). The replies to the questionnaire will be posted on the WIPO website and can be consulted as they come.
