Nice Classification

The class headings of the Nice Classification are accepted only in particular situations.

Representation before the Office

Local representation by a patent agent is required, when a person does not have a domicile or establishment in Poland.

Collective and Guarantee Marks

Regulations governing the use of the mark must be sent directly to the Patent Office, by a representative established in Poland within two months from the date of notification by the International Bureau to the Office of Poland of the international registration or subsequent designation, as the case may be. This period can be extended to a maximum of five months.

Replacement

No specific requirement - a fee of 50 PLN is charged by the Patent Office.

Transformation

The Office examines the transformed mark only on formalities. The holder must pay a transformation fee of 550 PLN.

Maintenance Requirement

None.

Licenses

Recording in the International Register in of trademarks licenses related to international registration is effective in Poland.
