Nice Classification

The Office does not accept the following terms of the Class Headings listed below. This practice entered into force for Spain on February 20, 2014.


TERMS NOT CONSIDERED TO BE CLEAR AND PRECISE:


Class 6: Goods of common metal not included in other classes;

Class 7: Machines;

Class 14: Goods in precious metals or coated therewith;

Class 16: Goods made from paper and cardboard;

Class 17: Goods made from rubber, gutta-percha, gum, asbestos and mica;

Class 18: Goods made of these materials [leather and imitations of leather];

Class 20: Goods (not included in other classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, mother-of-pearl, meerschaum and substitutes for all these materials, or of plastics;

Class 37: Repair; installation services;

Class 40: Treatment of materials;

Class 45: Personal and social services rendered by others to meet the needs of individuals.

Class 6: Construction elements of metal; building materials of metal;

Class 7: Agricultural machines; machines for processing plastics; milking machines;

Class 14: Works of art of precious metal;

Class 16: Filtering materials of paper;

Class 17: Rings of rubber;

Class 18: Briefcases [leather goods];

Class 20: Door fittings, made of plastics; figurines of wood;

Class 37: Shoe repair; repair of computer hardware; installation of doors and windows; installation of burglar alarms;

Class 40: Treatment of toxic waste; air purification;

Class 45: Personal background investigations; personal shopping for others; adoption agency services.

Representation before the Office

Local representation is required for all persons and entities outside of the EU and those from the EU without a domicile in Spain. Not necessary for EU members having a domicile for notifications in Spain. For non-EU members it is always necessary to have a representative (Official IP Agents only).

Collective and Guarantee Marks

No specific requirements.

Replacement

Recording of replacement takes place upon written request, filed with the Office. A fee of 37.27 EURO is required. The request is registered in a database and published.

Transformation

If the transformed mark has been granted protection in Spain, the Office examines on formalities only, but if the protection for the transformed mark has not been granted, the Office carries out the normal examination. A transformation fee of 135.94 EURO is required.

Maintenance Requirement

None.

Licenses

Recording in the International Register if a trademarks license related to an international registration is effective in Spain (Article 48 of the Trademark Law and Article 32 of the Regulations under the Trademark Law).
