Request for extension of protection

The Office does not republish notifications of international registration, subsequent designation or renewal received from the International Bureau.

Examination Procedure

Absolute and relative grounds.

Opposition Procedure

Three months starting on the first day of the month following the date of publication in the WIPO Gazette (non-extendable).

Time Limit for Responding to Provisional Refusal

Within a period of 15 days from the date on which the holder, or his appointed representative, received from the International Bureau of WIPO the notification of such a refusal.
When the date of receipt of the notification is illegible or absent, the request for review of refusal may be presented within a period of 30 days from the date where the notification was sent by the International Bureau of WIPO.
Any supplementary evidence referred to in a request for review shall be submitted to the Board within three months from the date upon which the said request was presented.

Administrative and judicial remedies in case of refusal issued by the Office

If the holder is not satisfied with the refusal/opposition, he can apply for review before the Trademark Review and Adjudication Board of the Trademark Office of the State Administration for Industry and Commerce of China (SAIC). If he is still not satisfied with the decision by the Trademark Review and Adjudication Board of the Trademark Office of the SAIC, he can appeal before the People's Court.
