Nice Classification

The Office accepts all of the class headings of the Nice Classification.

Representation before the Office

Local representation (attorney at law, a patent attorney, a notary or anyone having residence) is required if the holder of an international registration does not have a residence or an industrial establishment in Austria.

Collective and Guarantee Marks

Regulations governing the use of a collective mark must be sent to the Office within four months from the date the provisional refusal is sent in this regard (extendable).

Replacement

No specific procedure. Recording upon request.

Transformation

Other than formalities, in certain cases the Office examines applications resulting from transformation on absolute grounds also. The following fees are required: application fee of 300 Euro for three classes; 72 Euro for each additional class.

Maintenance Requirement

Not required.
