Data Collection: Explanatory Notes

General Definitions

Reporting Office

Enter the 2-character code for your office.  This will be automatically copied into the cell for "domestic" applications/registrations in the spreadsheet tables.

Notes

Use this box to add any necessary explanatory notes related to your statistics.

Origin

Origin is the country/territory of domicile or establishment of the first applicant or assignee of an intellectual property right.  If your office uses different criteria for origin, indicate this in the explanatory notes box.

 
Patent Definitions

Direct filings

Report the number of applications/grants which were applied for or resulted from direct national applications.  Designations under the PCT or regional patent systems should not be reported in this category .

Please do not include utility model / petty patent statistics in the patent questionnaires. If this is not possible, indicate this in the Notes box.

PCT National Phase Entries

Report the number of applications/grants which were applied for/resulted via the PCT route.  Statistics related to the International Phase of the PCT System or those relating to National Phase Entries at a regional office (if your office is a member of a regional office) should not be included in this category. If your office does not distinguish between direct filings and those received via the PCT, indicate this in the explanatory notes box and report all filings/grants under the "Direct filings at your office" or "Grants resulting from direct filings" column

Patent Grants Issued / Applications Rejected

A patent grant "issued" is a decision by the office to grant a patent irrespective of whether or not the applicant fulfills other administrative requirements such as the payment of associated fees for the patent.  A "rejected" application refers to the first decision made by a patent office at the end of the examination procedure.

Patents in Force by Year of Filing

Report the sum of all patents in force for each year in which they were filed regardless of the filing route: Direct, PCT or regional office (e.g. EPO).

 
Trademark Definitions

Number of Applications/Registrations

Report the number of applications/registrations which were applied for or issued via the direct national route. Applications resulting from designations made via the Madrid System should not be reported.

Number of Applications/ Registrations and Classes specified

A single application may specify one or several classes, depending on the jurisdiction.   Please report the number of  applications/registrations and, if applicable, the number of classes specified in applications/registrations. If your office does not record this information, indicate this in the explanatory notes box and leave the "Number of classes specified in these applications" column blank.

Marks in Force

For each year in which registrations were issued, report the total number of all trademark registrations in force that resulted from either direct applications or Madrid designations and the number of classes specified in these registrations in force.

 
Utility Models, Petty Patents, etc.

Type of Protection

A single questionnaire is provided for Utility Models, Petty Patents and other forms of protection for inventions other than patents.  Please use one questionnaire for each type of protection available in your office other than patents, and specify the type of protection in the space provided at the top of the questionnaire.

 
INDUSTRIAL DESIGN Definitions

Number of Applications/Registrations

Report the number of applications/registrations which were applied for or issued via the direct national route. Applications resulting from designations made via the Hague System should not be reported.

Number of Applications/ Registrations and number of designs contained

A single application or registration may contain one or more designs, depending on the jurisdiction.  Please report the number of  applications/registrations and the total number of designs contained in applications/registrations.  If your office does not record this information, indicate this in the explanatory notes box and leave the "Total number of designs contained in these applications/registrations" column blank.

Industrial Designs in Force

For each year in which registrations were issued, report the number of industrial design registrations in force that resulted from either direct applications or Hague designations and the number of designs contained in these registrations in force.
