Main Findings

23% of Japanese companies and organisations surveyed report that they have sustained damage due to counterfeiting in FY 2006 (April to March 2007). This is a one percent increase with respect to FY 2005; however, it is substantially lower than the 28.8% rate in FY 2002. The rate of damage continued to rise in China, South Korea and Taiwan. Large enterprises were more affected by counterfeiting (26.9%) than smaller and medium-sized enterprises (19.8%).

Infringements of trademarks, designs, patents and utility models decreased slightly. However, more copyright violations were reported in FY 2006. Damages due to counterfeiting were sustained mostly in China (with 71% of companies affected by counterfeiting reporting damages there), South Korea (30.4%), North America/Europe (about 18% each), and Thailand (13.7%). Almost two thirds of respondents (65.5%) reported that counterfeits of their products were produced in China.

37.3% of surveyed companies reportedly took anti-counterfeiting measures in FY 2006, for which on average they spent ¥ 5.7 million. The most common anti-counterfeiting measures taken are: “early filing of intellectual property rights in Japan and overseas” (65.9%), followed by “warnings to counterfeit manufacturers and distributors” (42.7%), and “investigation of manufacturers” (41.8%).

The anti-counterfeiting measures implementation rate was highest in Japan (56.6%), followed by China (38.7%), South Korea (21.3%), Taiwan (19.8%), the United States (19%), and Western Europe (14.6%). China was cited by many companies (30%) as the country where they plan to strengthen measures, followed by Japan, South Korea and Taiwan.
