Procedures Applying when this Contracting Party is Designated

Republication

The Office republishes the international registration, in Romanian, in the national Official Industrial Property Bulletin (BOPI), within 5 days from the date of publication in the International Designs Bulletin, at:
http://bd.osim.ro/dm/bopi_index.jsp?lang=en

Examination Procedure

The Office carries out an examination as to universal novelty and an examination as to novelty following opposition by third parties.

Opposition Period

Two months from the date of publication in the International Designs Bulletin (non-extendable).

Time Limit for Responding to Refusal

Two months from the date of the notification (non-extendable).

Effect as Grant of Protection

The international registration has the effect as a grant of protection, if no refusal has been issued, as from the international registration date. If a refusal (partial or total) has been issued and the refusal has been subsequently withdrawn, the international registration has the effect as a grant of protection as from the international registration date.

Representation before the Office

Holders may appear directly before the Office on some matters only. A list of industrial property attorneys allowed to practice before the Office is maintained by the Office which may be acquired directly, or at:

Fees payable on division of the international registration

Not applicable.
