Republication

The Office does not republish international registrations or renewals.

Examination Procedure

The Office carries out examination on substantive grounds, other than novelty, and carries out a limited examination as to novelty following opposition by third parties.

Opposition Period

Twelve months from the date of notice of opposition (non-extendable).

Time Limit for Responding to Refusal

Six months from the date of notification (extendable for two months from the date of the notice if the request is received during that period).

Effect as Grant of Protection

The international registration has the effect as a grant of protection as from 12 months from the international registration date.

Representation before the Office

Holders may not file documents or appear before the Office directly. Local representation is required by a trademark attorney. The Office maintains a list of patent attorneys allowed to practice before the Office. A list of trademark and patent attorneys is annexed to the provisional refusal, if issued.

Fees payable on division of the international registration

Not applicable.
