Procedures Applying when this Contracting Party is Designated

Examination Procedure

The Office carries out examination on substantive grounds, other than novelty, such as the compliance with the definition of a design, the contradiction to good practice, the existence of the name and state symbols of the Republic of Estonia and the emblems protected pursuant to Art 6ter of the Paris Convention. The Office also checks that the international registration consists of only one design or the variants or a set of one design.

Opposition Period


Time Limit for Responding to Refusal

Four months from the date of notification of the refusal (extendable for a maximum of six months).

Effect as Grant of Protection

The international registration has the effect as a grant of protection as from the date of publication in the Estonian Industrial Design Gazette (Eesti Tööstusdisainilahenduse Leht).

Creator requirements

The creator of the industrial design must be a natural person.

Representation before the Office

Holders of international registrations may not file documents or appear directly before the Office. Local representation is required by a patent attorney. The Office provides a list of patent attorneys available directly or at:

Fees payable on division of the international registration

A fee of 105 EUR applies, if the owner is a legal person; a fee of 26 EUR applies, if the owner is a natural person.
