Explanatory Notes
The list below provides definitions of terms used within the CLEA system.
Search Interface
- Subject matter: field of intellectual property covered.
- Type of legislation: identified according to the promulgating government's terminology as generally appearing in the full title (e.g,. Regulations, Rules, Order, etc.).
- Only show records including texts: not all records in CLEA are linked to the full legislative text (see 'Availability Notes' for further information). Select this option if you would like to restrict your search to records which link to a full text.
Results page
- Both short and full title are indicated. The short title is a conventional title given by WIPO to a text for classification and research purposes in CLEA and should not be considered official. Short title constitutes subject matter, type of legislation, date and number (if available).
- In the case of a non-consolidated text, date corresponds to date upon which a text is promulgated.
- In the case of a consolidated text, two dates are indicated: date of promulgation and date of latest amendment (e.g., Patents, Law (Consolidation), 19.06/1984 (18/08/1994).
Details page
- Date of basic text: reflects the date upon which the initial text was promulgated (announced by the official source).
- Date of entry into force of basic text: reflects the date of entry into force (commencement) of a text; this information is included in the record when available. In the case of a consolidated text, two dates are indicated: date of the basic text and date of text of the latest amendment.
- Officially published in: cites the official publication in which a given text is promulgated, inclusive of number and date when if available.
- WTO document number: reference used for the equivalent document record within the WTO Documents Online database.
Additional information
- WTO-notified text: indicates that a text has been notified by a WTO Member to the WTO Secretariat under Article 63(2) of the TRIPS Agreement.
- Main dedicated text: refers to main laws and regulations dedicated to intellectual property. These laws and regulations would include the main laws and regulations on the availability, scope and acquisition of each of the categories of intellectual property covered by the TRIPS Agreement, together with such other main laws and regulations as are dedicated to intellectual property, such as those on border enforcement.
- Other text: refers to all national laws and regulations which are not dedicated to intellectual property rights as such but which nonetheless pertain to the availability, scope, acquisition, enforcement and prevention of abuse of intellectual property rights (notably laws and regulations in the areas of enforcement and the prevention of abusive practices), as well as those laws and regulations dedicated to intellectual property which are not considered "main laws and regulations".
- Consolidated text: a text integrating one or more amendments.
- Consolidated by: indicates the authority which undertook the consolidation (national authority, legislating organization or WIPO).
- Title only: indicates that a text has been notified but copy thereof is neither dispatched nor received, i.e., only the title is available to WIPO.
Relations
- Amends (Is amended by): indicates that a text amends the related text by adding to, deleting from, repealing or superseding one or more (but not all) of its provisions.
- Is a consolidation including (Is included in consolidation): indicates that a text integrates some or all of the related text.
- Refers to (Is referred to in): indicates that the text refers to the related text(s) in the database.
