If Government officials are protected in their official capacity, then it should be under the Government and not personal name. iii. Bad faith - registration done for wrong intentions, - registration of same name well knowing it already exists and being aware that it will be misleading of another person's trade etc. abusive - name not used for purposes for which is was registered, or used for illegal transactions misleading - name resembles so much an existing one that it harms the one who was registered first iv Should advise parties to get to a compromise so one changes or modifies the name; otherwise, should be subjected to dispute settlement v The one already existing under WIPO Domain Names ( mediation, mediation followed by arbitration or arbitration) vi I believe directory or listing, if directories or lists are open to public, should be sufficient. I am convinced that if one is in position to register a personal name, they should equally be able to afford the little costs, if any, of accessing the lists or directories, before they register. C.
