Name: Lee Wiest Trademarks are how something appears, visually. (Mark -- not sound!). How in the heck did educated people ever get off the track so far? Under the current system, everything in the world is "owned" by common people, not business interestes, but business gets to "own" them, if a common person has it! What sickness. Again, a "mark" is a visual representation that can not be duplicated (in good faith), but by no means is it anything else. IBM without the lines and particular typeface and particular letter spacing, etc. is not the same as IBM using the typeface Times Roman. Though they sound the same, they certainly do not "Look" the same, and only to an idiot are they "confusingly similar." |
