Advanced Technical Strategy, Inc. assists large-scale organizations in
developing distributed systems strategy (Internet, e-commerce, massively
scalar systems etc.), included is our 2c worth regarding Trademark and
Internet Domain Name concerns.
INTERNET DOMAINS > TRADEMARKS
It must firstly be recognized that countries individual trademark bodies are
substantially subordinate to the Internet domain registration system. This
may come as a shock to many of these lesser trademark organizations, however
Internet spans the globe in one large network that is not divided by smaller
incompatible and unintegrated fiefdoms.
Just as all the different countries individual governmental trademark bodies
have problems with trademark infringements, which are often due to the
simple fact that trademark owners in another country did not register their
trademarks with each and every individual countries governmental trademark
body before someone else took the name, Internet Domain Name registration
faces the same problems. However, one must recognize that at least Internet
Domain Name registration is global, something that does not seem to have
been obtained by the more antiquated individual trademark bodies.
So in light of these simple facts, if a company or an individual is not up
to date enough to register a domain name on the Internet, then it is that
companies or individuals problem and not the Internet Domain Registration
Service's problem. It is certainly much simple and vastly less complicated
to register a domain name than it is to protect a trademark around the
globe.
It is time to face the facts, Internet has superceded the lesser trademark
organizations, these organizations should fall in line behind the Internet's
naming infrastructure, or at least offer something that is as simple and as
cost effective to use.
Kindest regards,
Clive
P.S. Not to be rude, but do you think anyone on the Internet is going to
bother with WIPO? I just happened to come across your article in a minor
InfoWorld article and thought you may appreciate some input.
