For US domain name owners:
A hierarchy of priorities should be followed for resolving domain name disputes, beginning with federally registered trademarks but not limited to same.
Registration of a corporation with a state should be given substantial weight if such corporation was the first to register a domain name, as registration of a corporation is essentially the same as having a state trademark.
Two corporations having the same name, incorporated in different states, with neither having federally registered a trademark, that both seek a domain name identical to their corporate names, must follow a strict domain name registration priority rule. Registration of a federal trademark by one such corporation AFTER domain name registration by the other corporation in such a case should NOT invalidate a domain name assignment.
Thanks,
Marc
