Please note that the statement to be included pursuant to Paragraph 3 (b) (xiii) must specify an express choice of one (or both) of the two Mutual Jurisdiction options, i.e. the courts at the location of the principal office of the registrar (provided the domain name holder has submitted in its registration agreement to that jurisdiction for court adjudication of disputes concerning or arising from the use of the domain name) and/or the domain name holder's address as shown for the registration of the domain name in Registrar's Whois database at the time the complaint is submitted to the Provider. Please see also Paragraph 1 (Definitions) of the Rules.
Example:
For the purposes of paragraph 3 (b) (xiii) of the Rules, the Complainant shall submit, with respect to any challenges by the respondent to a decision in the administrative proceedings cancelling or transferring the domain name that is the subject of the complaint, to the jurisdiction of the courts of the Eastern District of Virginia (United States of America) where the principal office of Network Solutions, Inc., the registrar of the domain name, is located.
